Frequently Asked Questions

If I am in an accident, what do I do?

Answer: If an accident occurs and a person is injured or there is damage to the vehicles, call 911 at once. Identify the other driver and vehicle and obtain their contact information. Identify any witness to the accident and make sure to get their name and phone number. A police report should be filed and you should review it carefully to make sure it is accurate. Do not admit liability, as this is a legal matter and should be properly investigated to determine fault. It is important to take photos of the vehicles, the roadway and any injuries you sustain.

If I am injured in an accident in a vehicle registered in New York or if the accident happens in New York State, who pays my medical bills?

Answer: New York has enacted a No Fault Insurance statute that provides that the medical bills of any person injured in a motor vehicle accident in a vehicle registered in New York or if the accident happens in the State of New York be paid by the insurance carrier for the vehicle in which you were a driver or a passenger.

 

If I am hit by a vehicle while a pedestrian or riding a bicycle, who pays my medical bills?

Answer: If the accident is in the State of New York or if you are hit by a vehicle registered in New York your medical bills will be paid by the insurance carrier for the vehicle that hit you under its No Fault Insurance policy.

Do I have a claim for the injuries I sustain if I am struck by an uninsured vehicle or if the vehicle leaves the scene of the accident and cannot be identified?

Answer: Even if the vehicle that causes the accident is uninsured or cannot be identified you still have a claim against your own carrier for Uninsured Motorists/Supplementary Uninsured Motorist Coverage. All insurance carriers for New York vehicles (or vehicles in New York State) are required to provide UM/SUM coverage with limits of at least $25,000/$50,000. If you are a pedestrian without car insurance you can make a claim to the Motor Vehicle Accident Indemnification Corporation a not-for-profit agency created by the New York State Legislature.

If I am injured in an accident should I speak to the other vehicle's insurance company?

Answer: If you have been injured in an accident it is important that you do not speak to any representative from the other vehicle’s insurance company. First, call an attorney that is experienced in accident cases so that they can explain the claims process and act to be sure your rights are protected. If you sign a written Retainer with your attorney they will contact the insurance company on your behalf. It is important that you be represented by counsel to protect your rights and make sure that your claim or legal action is aggressively prosecuted so that you are compensated for the damages you sustain.
